TERMS AND CONDITIONS
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period during which the consumer may exercise their right of withdrawal.
Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
Day: calendar day.
Long-term transaction: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
Durable medium: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: a contract concluded between the entrepreneur and the consumer through an organised distance sales system for products and/or services, using one or more means of distance communication up to and including the conclusion of the contract.
Means of distance communication: any method that can be used to conclude a contract without the consumer and entrepreneur being present in the same room at the same time.
Terms and Conditions: these general terms and conditions of the entrepreneur.

Article 3 – Applicability
These terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded where the terms and conditions can be reviewed and that they will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these terms and conditions may, contrary to the previous paragraph, be made available electronically in such a way that the consumer can easily store them on a durable medium.
If specific product or service conditions also apply in addition to these terms and conditions, the second and third paragraphs apply accordingly. In the event of conflicting conditions, the consumer may rely on the provision that is most favourable to them.
If one or more provisions in these terms and conditions are wholly or partially invalid or annulled, the agreement and these terms and conditions will otherwise remain in force. The relevant provision will be replaced by a provision that most closely reflects the original intent.
Situations not covered by these terms and conditions, or uncertainties about the interpretation of provisions, will be assessed and interpreted in the spirit of these terms and conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be clearly stated.
The offer is non-binding. CORDE is entitled to change and amend the offer.
The offer contains a complete and accurate description of the products and/or services offered, detailed enough for the consumer to make a proper assessment. Images are a truthful representation; obvious mistakes or errors do not bind the entrepreneur.
All images, specifications, and data are indicative and cannot give rise to compensation or termination of the agreement. CORDE cannot guarantee that displayed colours exactly match the actual colours of the products.
The offer clearly states the rights and obligations associated with acceptance, in particular:
- the price, excluding customs clearance costs and import VAT, which are the responsibility of the recipient;
- any shipping costs;
- the way in which the agreement is concluded and the required steps;
- whether or not the right of withdrawal applies;
- the method of payment, delivery, and performance;
- the period for accepting the offer or the period during which the price is guaranteed;
- the rate for distance communication if this differs from the basic rate;
- whether the agreement is archived and, if so, how the consumer can consult it;
- the way in which the consumer can check and correct the information provided before concluding the agreement;
- any other available languages besides Dutch;
- the codes of conduct to which CORDE is subject and how these can be consulted electronically;
- the minimum duration of a long-term transaction;
- optionally, available sizes, colours, and materials.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set out.
If the consumer has accepted the offer electronically, CORDE will immediately confirm receipt of this acceptance electronically. As long as this receipt has not been confirmed, the consumer may terminate the agreement.
When an agreement is concluded electronically, CORDE will take appropriate technical and organisational measures to secure the electronic transfer of data and ensure a safe online environment. Appropriate security measures will be taken for electronic payments.
Within legal limits, CORDE may investigate whether the consumer can meet their payment obligations and assess all facts and factors relevant to responsibly entering into the agreement. If there are good grounds to do so, CORDE may refuse an order or attach special conditions to it.
CORDE will provide the following information with the product or service, either on paper or electronically:
- the visiting address where the consumer can submit complaints;
- the conditions and method for exercising the right of withdrawal, or a clear statement if this right is excluded;
- information about warranties and after-sales service;
- the information listed in Article 4, paragraph 5, insofar as this has not already been provided;
- the cancellation requirements if the agreement lasts longer than one year or is of indefinite duration.
For long-term transactions, the previous paragraph only applies to the first delivery.
Every agreement is entered into under the suspensive condition of sufficient availability of the relevant products.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the right to terminate the agreement within 14 days without giving any reason. This period starts on the day after receipt by the consumer or their designated representative.
During the cooling-off period, the consumer must handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to determine its nature, characteristics, and functioning.
If the consumer exercises their right of withdrawal, they must return the product with all accessories and, where reasonably possible, in its original condition and packaging, in accordance with the reasonable and clear instructions provided by CORDE.
The consumer must notify CORDE in writing, by email, within 14 days of receipt that they wish to exercise their right of withdrawal. The consumer must then return the product within 14 days. The consumer must be able to prove that the return shipment was sent on time, for example with proof of shipment.
If the consumer does not withdraw or return the product on time, the purchase is final.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the return shipping costs are the responsibility of the consumer.
Amounts already paid will be refunded by CORDE as soon as possible, but no later than 14 days after withdrawal, provided that the product has been received or the consumer has provided conclusive proof of complete return shipment.
Article 8 – Exclusion of the Right of Withdrawal
SHOP NAME may exclude the right of withdrawal for products and services listed below, provided this is clearly stated in the offer or at least in good time before the agreement is concluded.
Exclusion is possible for products:
- made according to the consumer’s specifications;
- that are clearly personal in nature;
- that cannot be returned due to their nature;
- that can spoil or age quickly;
- whose price depends on fluctuations in the financial market over which CORDE has no control;
- loose newspapers and magazines;
- audio and video recordings and computer software where the seal has been broken;
- hygiene products where the seal has been broken.
Exclusion is possible for services:
- relating to accommodation, transport, restaurant services, or leisure activities on a specific date or during a specific period;
- whose delivery has begun with the consumer’s explicit consent before the end of the cooling-off period;
- relating to betting and lotteries.
Article 9 – The Price
During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for changes resulting from changes in VAT rates.
Contrary to the previous paragraph, CORDE may offer products or services with variable prices if these prices are linked to fluctuations in the financial market over which CORDE has no control. In that case, it will be stated that the prices mentioned are indicative prices.
Price increases within 3 months after the conclusion of the agreement are only permitted if they result from legal regulations or provisions.
Price increases from 3 months after the conclusion of the agreement are only permitted if this has been agreed and:
- they result from legal regulations or provisions; or
- the consumer is entitled to cancel the agreement from the day on which the price increase takes effect.
The place of delivery, in accordance with Article 5, paragraph 1 of the Dutch Turnover Tax Act 1968, is the country where the transport begins. Delivery takes place outside the EU. Upon import, import VAT and/or customs clearance costs may be collected from the customer by the postal or courier service. Therefore, CORDE does not charge VAT.
All prices are subject to printing and typographical errors. No liability is accepted for the consequences of such errors. In the event of printing or typographical errors, CORDE is not obliged to deliver the product at the incorrect price.
Article 10 – Conformity and Warranty
CORDE guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, reasonable requirements of reliability and/or usability, and the legal provisions and regulations applicable on the date the agreement was concluded.
If agreed, CORDE also guarantees that the product is suitable for use other than normal use.
Any warranty provided by CORDE, the manufacturer, or the importer does not affect the consumer’s statutory rights and claims.
Any defects or incorrectly delivered products must be reported in writing within 14 days after delivery. Products must be returned in their original packaging and in new condition.
The warranty period of CORDE corresponds to the manufacturer’s warranty period. CORDE is never responsible for the ultimate suitability of products for individual applications by the consumer, nor for advice regarding the use or application of products.
The warranty expires if:
- the consumer has repaired or modified the products themselves or had this done by third parties;
- the products have been exposed to abnormal conditions, handled carelessly, or used contrary to instructions;
- the defect is wholly or partially the result of government regulations regarding the nature or quality of the materials used.
Article 11 – Delivery and Performance
CORDE will take the greatest possible care when receiving and processing orders.
The place of delivery is the address provided by the consumer to CORDE.
Orders will be processed as soon as possible and no later than 30 days, unless a longer delivery period has been agreed. If delivery is delayed or cannot be carried out fully or partially, the consumer will be notified no later than 30 days after placing the order. In that case, the consumer may cancel the agreement free of charge and is entitled to a refund within 14 days.
If delivery of an ordered product proves impossible, CORDE will make an effort to provide a replacement item. If a replacement item is delivered, this will be clearly stated. Return costs in the case of replacement are borne by CORDE.
The risk of damage and/or loss of products rests with CORDE until the moment of delivery to the consumer or their representative, unless expressly agreed otherwise.
Article 12 – Long-Term Transactions: Duration, Cancellation, and Renewal
Cancellation
The consumer may cancel an agreement of indefinite duration, which involves the regular delivery of products or services, at any time with a notice period of no more than one month.
The consumer may cancel an agreement for a fixed term, which involves the regular delivery of products or services, at any time at the end of the fixed term with a notice period of no more than one month.
The consumer may cancel the agreements mentioned above:
- at any time and not limited to a specific moment or period;
- in the same way as they were entered into;
- with the same notice period as CORDE has stipulated for itself.
Renewal
An agreement for a fixed term may not be tacitly renewed or extended, except:
- subscriptions to daily, news, and weekly newspapers, which may be tacitly renewed for a maximum of three months with a notice period of one month;
- agreements that are tacitly renewed for an indefinite period, where the consumer may cancel at any time with a notice period of no more than one month, or three months if delivery takes place less than once per month.
Trial or introductory subscriptions end automatically after the agreed period.
Duration
If an agreement lasts longer than one year, the consumer may cancel it at any time after one year with a notice period of no more than one month, unless reasonableness and fairness oppose this.
Article 13 – Payment
Unless otherwise agreed, amounts owed by the consumer must be paid within 7 business days after the start of the cooling-off period referred to in Article 6, paragraph 1. In the case of a service, this period starts after confirmation of the agreement.
The consumer is obliged to immediately report inaccuracies in provided or stated payment details.
In the event of non-payment, CORDE has the right, subject to legal restrictions, to charge the consumer reasonable collection costs.
Article 14 – Complaints Procedure
Complaints about the performance of the agreement must be submitted in writing to CORDE within 7 days after discovery, fully and clearly described.
The consumer will receive a response within 14 days after receipt of the complaint. If handling the complaint requires more time, the consumer will receive confirmation of receipt within 14 days, including an indication of when they can expect a more detailed response.
If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.
A complaint does not suspend the consumer’s obligations unless CORDE states otherwise in writing.
If a complaint is found to be justified, CORDE will, at its discretion, replace or repair the products free of charge.
Article 15 – Disputes
Agreements between CORDE and the consumer to which these terms and conditions apply are exclusively governed by Dutch law, even if the consumer lives abroad.
Article 16 – CESOP
In connection with measures introduced from 2024 regarding the amendment of the Dutch Turnover Tax Act 1968, the implementation of the Payment Services Directive, and the central electronic system of payment information known as CESOP, payment service providers may register data in the European CESOP system.
